A trooper pulled up behind, and eventual...ly arrested client who then blew a .16. Client faced denial of citizenship and right to remain in the U.S. After challenging the trooper's investigation on all fronts, the Court dismissed case over the prosecutor's strenuous objection, finding that the client was improperly seized.

Client was arrested for DUI after his car went into a ditch. There were three people in the car, but all had gotten out by the time police arrived. Multiple witnesses told police client was the drive...r, and he blew a .11 breath test. Client faced the loss of his career over the incident. After challenging the eyewitnesses and the breath test, the DUI case was dismissed on the morning of trial. Additionally, the State Department of Licensing tried to disqualify his commercial driver's license for a year. We appealed that case to Superior Court, where the judge granted our motion to cancel the license suspension based on irregularities with the police officer's sworn report. The client never lost his license, and his career was saved.

Client was charged with DUI-Refusal after getting stopped by police for multiple lane violations on freeway. Following his arrest, client refused the breath test. Client lived on the East Coast and ...was in town for business and driving a rental car. Client had to fly in to appear in court one time, but was otherwise excused from attending all pretrial hearings over the course of a year while the case proceeded towards trial. The arresting trooper repeatedly denied our request to be interviewed, so we got the judge to order the trooper to appear at our law office for a deposition. When the trooper failed to appear for the deposition, we made a motion to dismiss the case.
Result: Case dismissed entirely without the client ever having to return to court.

Client charged with DUI Refusal, Obstructing an Officer and Resisting Arrest. Client was stopped for speeding on his way into the airport after a Seahawks game. When the client declined the officer’s... invitation to get out of his car while trying to catch a flight, multiple hyper-vigilant airport police quickly respond. The situation quickly deteriorates and police break out his car windows, and pull him from his car. Client is badly beaten by police, and later refuses the breath test. The prosecutor and police aggressively pushed the case, and we brought a pre-trial motion to suppress all evidence and dismiss the case. After the first police witness testified at our hearing, the court called a 15 minute recess. During that time, the officer who had already testified was seen through an office window having a discussion with the two police officers who were next to testify. Because the judge had previously granted our request to prohibit witnesses from discussing their testimony with other witnesses, this was a violation of that ruling. Accordingly, the judge granted out motion to exclude all testimony from those two police officers. As those were the officers that did the majority of the DUI investigation, this effectively gutted the prosecution’s case.
Result: Negligent Driving, all other charges dismissed.

Client charged with DUI, Hit and Run, Driving Without Interlock Device and Giving False information to a Police Officer. This was client’s fifth DUI charge. Following a small fender bender in a night...club parking lot, client’s truck with two males inside quickly left the parking lot without stopping. Client was later arrested outside the nightclub. Police find client’s truck nearby, without the required interlock device. Client told police he was not driving the truck, and that he had not been drinking that evening. Multiple witnesses told police that they saw client driving the truck, and he gave a .24 breath test. Our own investigation produced several witnesses, and the case proceeded to a four day jury trial involving almost twenty witnesses.
Result: Not Guilty on the DUI, Hit and Run and Interlock Charges. Guilty of false information for telling the police officer he had not been drinking.
