OUTCOME: Dismissed
My client was accused of assaulting her husband. Through negotiation and legal argument, I was able to persuade the prosecutor to dismiss all charges against my client.
OUTCOME: Amended to Disorderly Conduct - Bail Forfeiture
My client had allegedly violated an anti-harassment order by sending an e-mail. I was able to convince the prosector that he had a de minimus violation on his hands, and convinced him to amend the char ... ge to a non-domestic violence charge, and allow bail to be forfeited at $300 to close this case without a conviction.
OUTCOME: Felony DUI Amended to Misdemeanor
My client had five prior DUIs lifetime, and had a BAC level at .12 in this case. He made incriminating statements, was driving without his interlock, with a revoked license, and failed all field sobrie ... ty testing. He originally faced approximately 5 years in prison. Due to several legal issues in the case, we were able to brief out motions that compelled the prosecutor to amend his charge to misdemeanor DUI, and sentence him to 12 months in custody only.
OUTCOME: Dismissed
This case was dismissed despite my client having prior DUI offenses and blowing a .30 breath test.
OUTCOME: Negligent Driving Second Degree
This case was amended to negligent driving in the second degree at my client's arraignment, even though his BAC was above .15 and he'd admitted to drinking.
OUTCOME: Dismissed
This case was dismissed at motions, despite the client having a breath test above .18, swerving around the road, and showing signs of intoxication.
