The foreign national spouse of a US citizen could not adjust to lawful US residency because he entered without a visa. A waiver of the foreign national's unlawful presence was required, but the couple ... did not have the traditional indicia of extreme hardship to the US citizen. The couple are in their late-40s and have no children. The foreign national does not work, but stays at home to care for a good friend of the couple who has serious health issues.
