James D. Reddy handled the trial and the appeal of the sanction. On appeal, Mr. Reddy successfully argued that no hearing was required where, as here, the sanction was expressly requested as the desired relief in a cross-motion and the mother's attorney had failed to take advantage of his opportunity to be heard. The Appellate Division, Second Department, affirmed the $2,500 and awarded the father his costs and disbursements in defending the appeal.
