A construction worker was seriously injured on the job when he fell from a floating dock while working on a retaining wall for a large beverage company in Brooklyn. The worker received workers' compen ... sation through the subcontractor but was barred from suing his employer. The workers' compensation benefits he received were limited by law and did not completely compensate him for his lost wages and out-of-pocket medical costs, not to mention his pain and suffering. On behalf of the worker, we filed a third-party lawsuit for negligence against the beverage company and general contractor, arguing that the floating dock's lack of any safety railings created a dangerous condition. After we defeated the defendants' motion for summary judgment, we negotiated a significant six figure settlement for the construction worker's injuries.
