Mr. Reif's clients allege that the defendants generated excessive commissions, failed to disclose the risks and cumulative commissions, and did not report or act on the investor’s known diminished capacity and relocation to a convalescent home. Jurors commented in post-verdict interviews about the persuasiveness of Brandon S. Reif’s arguments, which led to “12-0” jury votes on key defenses, and caused the rest of plaintiffs’ case to collapse on the merits. In post trial motions, Brandon S. Reif won $295,539.71 in attorneys' fees and costs.

Reif obtained an unprecedented defense verdict in a FINRA arbitration for a former independent broker-dealer, WFP Securities Corporation (WFP), its president, and a former registered represe ... ntative (RR) involving a $2.5 million portfolio of Regulation D private placements and Public Non-Traded REITs that the public investor purchased between the years 2004 and 2009. In a reasoned award, the FINRA arbitration award (Award) dismissed the claim entirely, granted the expungement from the Central Depository Records (CRD) for the president and the RR, and found the public customer liable to respondents for defense costs and expert witness fees in the amount of $135,755.89. The FINRA Panel unanimously found that the customer’s claim was “false” and “barred as a matter of law” by the “applicable statute of limitations”. The FINRA Panel also unanimously found that the customer was attempting to seek a “double recovery” in violation of FINRA Rule 12209 by simultaneously pursuing her claims against the respondent FINRA members as well as separate claims against the investment sponsors and their principals in private settlement negotiations, arbitration forums and court.

It was a one-of-a-kind verdict for $1,627,161.60 because the three member arbitration panel tripled the ... compensatory award ($319,798) and awarded attorneys' fees, costs and prejudgment interest. Mr. Reif and his client accused StockCross of Beverley Hills, Calif of recommending unsuitable and overly risky investments that were traded on margin. The firm and its brokers traded options on margin, bought reverse convertibles and used the equity in his home with a reverse-mortgage transaction.
