Joshua B Lay-Perez

My husband retained Joshua B. Lay to represent him in a personal injury case arising from a motor vehicle accident in which he was injured. I was actively involved in communicating with the office throughout the representation. A lawsuit was filed, but the defendant was never served. Court records... show that the court issued a Notice of Intent to Dismiss, and the case was later dismissed. Neither my husband nor I were informed that service had been unsuccessful, that the court had issued a Notice of Intent to Dismiss, or that the case had been dismissed. After multiple attempts to obtain a status update, I discovered the dismissal myself by reviewing the Marion County Circuit Court’s public records. By that time, the statute of limitations had expired, and my husband could no longer pursue his claim against the other driver or the other driver’s automobile insurance company. Clients place tremendous trust in their attorney to protect their legal rights, communicate significant developments, and diligently pursue their case. That did not happen here. Because of these events, I filed a complaint with the Oregon State Bar and await its response. Based on our experience, I cannot recommend Joshua B. Lay.
