Maybe. The only other possibility, if recognized under TX law is a diminution in value claim for the difference in the value of your car-even...
If the person who sold you this coverage was negligent, it would be far easier to sue them under their errors and omissions policy and not go after...
I'm very sorry for your situation but based on the facts you have posted, I do not see any viable cost effective claim for medical malpractice...

Yuck. IF you can prove what you've stated in your post, you may have a claim for "outrageous conduct" but you would still have to establish that...

You should turn this over to your insurance carrier and let them deal w/this for you. Sorry about your circumstances.
