Most passive attorney ever
I hired Todd to help me with my divorce. To be honest, I feel like all he did was forward me emails from my x-wife's attorney- "what do you want to do?". I appreciate my client taking the time to write a review. Ethically, I am not permitted to respond in any detail to the specifics of my client's case, as to do so may violate the attorney-client privilege. I can say, however, that I am not passive in the representation of my clients. I can also say that I am certain the services I provided far exceeded simply forwarding my client emails and asking him "what do you want to do?" The client does have the ultimate authority to decide the material issues in his or her case. As such, I am certain that, at times during the litigation, I did ask my client how he wanted to proceed, as I do in every case, and as I am ethically required to do. I wholeheartedly disagree, however, that I never offered any ideas or suggestions, or never discussed possible courses of action. I am dedicated to zealously representing my clients, which includes explaining the law to my clients, explaining how the law applies to the facts in his or her case, and explaining the potential courses of action and the likely outcomes. I have done this in every case in my more than 26 years of practicing law, and I will continue to do so. I do wish that my client had discussed these issues with me during the case so that I had the opportunity to further explain his issues of concern. As always, I wish my client the best. Todd R. I hired Todd, with borrowed money and informed him up front that I couldn't afford much. "Don't worry" he assured me "my assistant does a lot of my work" and when I asked her rates, they were much more reasonable. I want to first thank my client for taking the time to comment, although I do wish she had been a bit more positive in her critique. I am unable to respond specifically to her assertions as they relate to her case, as she has chosen to remain anonymous, and the rules of professional conduct prohibit me from revealing a client's confidences and secrets. I can say this, however. I am not "shady" as she asserts. I have always conducted myself professionally and ethically, and will continue to do so. I am always candid and forthright with my clients in all matters of their cases, both regards to billing and financial issues, and with regards to the law pertinent to the client's case and the application of the law to the particular facts of the case. I understand that litigation is expensive, and that many clients cannot afford large retainers. Because of this, in my more than 22 years of practice, I have always accepted smaller retainers and payment plans. My hourly rate is always at the lower end of what other attorneys in the area with similar experience charge. Tasks that can be assigned to my legal assistant are assigned to my legal assistant, and are billed at her lower hourly rate. There are some tasks, however, that must be performed by an attorney. I send out detailed billing statements each month reflecting all charges and costs incurred for that month, such as court filing fees or process server fees. Everything is completely visible to the client. The insinuation that I somehow deleted other unfavorable reviews is without merit. As far as I know, there have been no additional reviews other than those listed on this page. There is no way for me to remove reviews from the Avvo website. In all of my cases, I keep my clients fully informed about the status of the case and the developments in the case as they arise. I thoroughly discuss with my clients their goals in the case, the law in the case, and how the facts and the law may help or hinder the client from achieving his or her goals. I do this so that the client can make a fully informed decision whether to attempt to reach a settlement with the opposing party, or whether to proceed to hearing or trial. This is done well in advance of the hearing or trial whenever possible. When the client decides to proceed to hearing or trial, I fully prepare for the hearing or trial, and zealously represent my client. Unfortunately, there are cases where the facts and the law, over which I have no control, are not favorable to my client. I understand the client is disappointed in these circumstances, but this does not relieve the client from his or her obligation to pay for the services provided. WorthLESS!
I could have done better myself. This guy is very under spoken, has little fight, and basically laid down and did nothing. I paid big money to lose my children... very disappointing!
I appreciate my former client's time in providing this review, but wish s/he would have spoken to me with his/her concerns first. I realize, however, that family law litigation is often stressful and emotional, and that attorneys often receive the brunt of their clients' emotions. I am unable to respond specifically to my former client's assertions, both because s/he has chosen to remain anonymous, and because the ethical rules governing attorneys in Oregon prohibit revealing a client's confidences and secrets. I can say, however, that I whole-heartedly disagree with my former client's assertion that I am "under-spoken" and have "little fight". I have been practicing law for more than 22 years. During that time. I have assisted thousands of clients in achieving their goals in divorce, child custody, and other family law cases, and in Social Security Disability, personal injury and other general litigation cases. I always conduct myself professionally and ethically while representing my clients' interests zealously. I am always polite to opposing counsel, opposing parties, and the court while at the same time being an effective advocate for my client. I understand that, in the heat of litigation, some view politeness and civility as a sign of weakness, but it really should be viewed as a sign that I and my client are confident in our case and the positions we are taking. Litigation, by its nature, is unpredictable. The outcome in any litigation depends in large part on the facts of a particular case and the law applicable to those facts. I have no control over the facts that occurred before I began representing my client, including the actions my client took before I became involved. Sometimes, the client's prior actions are detrimental to his or her stated objectives. I am committed to representing each of my clients zealously and aggressively while maintaining the highest ethical standards and standards of professionalism. I have conducted myself this way in my more than 22 years of practicing law while assisting thousands of clients, and I will continue to do so.
