A personal injury case. The injured party was in a store when a "post pounder" fell on her foot. I wrote the summary judgment motion that was granted in favor of the store at the trial court level. The ... result was affirmed twice on appeal. The case law is instructive because even though the legal standard to apply is favorable to the injured party, her evidence was deemed too speculative to permit a jury to decide the matter.
