Undocumented crime victim (and family members) granted U non-immigrant status
Jul 08, 2014OUTCOME: Deportation terminated and client and family now are all documented.
Clients came to us because they were undocumented and wanted to explore possibilities. Upon a thorough interview, we found that client was a victim of an attack in another state some five years ago. ... We contacted law enforcement of that state and we were provided by copy of arrest reports. District attorney, however, only certified case as a misdemeanor and not a felonious attack. Despite this hurdle, we were able to argue that our client's case was substantially similar to crimes covered by the U visa and our client was granted U status, including his wife and unmarried adult son. We were also able to terminate client's deportation order in absentia in Arizona, giving client a clean slate to start his life in the United States and live the American Dream.
