Felony Domestic Violence and Assault with a Deadly Weapon
Mar 01, 2021OUTCOME: After 6 months of aggressively fighting the case, the prosecution agreed to dismiss the case due to lack of evidence. Client tearfully celebrated and was able to begin putting his life back together.
Client's prior counsel (improperly) advised him to plead guilty to the charges, despite client's belief that he was innocent. Having deeply regretted his decision, client came to us for help. We then s ... uccessfully filed a motion to withdraw his plea in order to fight the case again. Later, we were able to get a highly favorable statement from the alleged victim. And at the evidentiary hearing, the victim testified that the incident was an accident. On cross-examination, the investigating deputy admitted that the incident seemed like it could have been unintentional. He also admitted to inconsistencies in his police report and that he failed to interview 2 key witnesses.
