Does not follow CA rental laws, advising his clients with pure speculation and hypotheticals

This attorney is retained by NVMP (property managers) and his findings about overpayments for non-exempt landlords was nothing short of science fiction. Background: in 2020, after AB-1482 passed, our landlord unlawfully raised our rent from $1,500 to $1,650. However, since our landlord was not exemp...t from the rent cap laws, she's been overcharging us for over two years. This attorney has attempted to tell his client that instead of paying us back $4,200, she (the landlord) just owes us a fraction of that amount? Why? Evidently the attorney owns a DeLorean and can go back in time and fix what his client did wrong. How convenient! What if I were a store manager and had overcharged a customer. A week later the customer comes back and shows his receipt, proving that he was overcharged for an item that was mis-marked; the item was supposed to be $50, but it was marked at $100. Instead of the manager doing the obvious, and giving the customer $50 back, he consults his attorney and the attorney suggests that he change the receipt to be $75, explaining to the store manager that at the time, the manager did have the right to charge $75 for the item, and so retroactively he can do so now. The manager goes back to the customer and explains what the attorney said, and hands the customer a $25 refund—instead of the $50. I'm sure the customer would be absolutely flabbergasted and demand that the manager do the right thing. The attorneys advice is the same. It is absolutely absurd and goes against all common sense. There is no precedence for such advice, but is purely based upon a "what if" and "science fiction" scenario. He should be reported. I'd give him ONE STAR if I could, but the form won't allow that.

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
