OUTCOME: The Sellers, represented by Nadel & Associates P.C., were successful at the Trial Court level as the Court rejected the Purchaser’s argument and dismissed their case. The decision was later affirmed on appeal in the Appellate Division, First Department.

Purchasers failed to appear at a “time-of-the-essence” real estate closing. The Purchasers commenced legal action against the Sellers in Supreme Court, New York County for the return of the down-paymen ... t deposit, based on alleged misrepresentations by the broker regarding air-conditioning. The Sellers’ position was that the contract language regarding the air-conditioning was clear and any misrepresentation by the broker was not relevant.
