Mr. Pereira represented Macy's of California versus the Solano County Superior Court. The Superior Court denied Mr. Pereira's Motion for Summary Judgment after Plaintiff sued Macy's based upon a fear ... that she might contract the HIV virus after encountering drug paraphernalia in a jacket returned by another customer. Mr. Pereira sought a Writ of Mandate, on behalf of Macy's, from the Appellate Court, to overrule the trial court, and to command the trial court to reverse its decision and to rule in favor of Macy's. The Appellate Court agreed with Mr. Pereira and issued the Writ of Mandate.
