OUTCOME: Addressing an issue of first impresssion, the court dismissed the federal indictment dismissed on statute of limitations grounds finding the government could not justice sealing and thus the statute of limitations was not tolled.
An individual was indicted for making false statements in a bankruptcy proceeding, fraudulently concealing assets, and income tax evasion. Over a period of 21 months, the government secured and then s ... ealed an indictment and four superseding indictments. The final indictment was unsealed after the statute of limitations had expired on all counts. The defendant moved to dismiss the indictment on the ground that it was barred by the statute of limitations since the government did not have a proper basis for sealing.
