Employee ? Independent Contractor?

An international company has been conducting business with sales representatives/managers worldwide. One of the managers needed to be transferred to the US subsidiary but was questioned by the Immigra ... tion Services as to his employment history during the past three years at the company as an employee. The company and the manager had an existing agreement with the word "independent contractor" peppered throughout the agreement. We were able to persuade the Immigration Services that, despite the existing agreement was named independent contractor agreement, the manager was nonetheless an managerial employee at the company and therefore eligible for a visa transfer.
