Client

I retained Ms. Davitt in May of 2017 in order to file a Motion for Reconsideration in a probate case involving my mother. 1) She filed the Motion too late 2) She included documentation that was not included in the original hearing. The Court denied the motion. Then Ms Davitt decided to file a Motion ...for an Appeal. It is not clear, but she may have filed that too late. Ms. Davitt agreed to other tasks which none of were ever completed yet gladly billed for them. Ms Davitt attempted to coerce me into dropping the appeal claiming that it was too expensive for me as if it was my fault that we had to make a motion for an appeal when it was Ms. Davitt's negligence that caused the less expensive Reconsideration motion to be denied. She also missed some other bar dates one of which I personally had to fix. She filed a motion for withdrawal on October 30th but was already over 30 days late for filing critical documents in the appeals case. On November 3, 2017 the Appeals Court Clerk sent out a demand threatening sanctions if the documents were not filed by November 13, 2017. On November 9th I feared sanctions and called the Clerk my self and she informed that the transcript was not filed yet. She told me to call the Court Reporter myself which I did. During this time she represented me and had not obtained her withdrawal. I called the reporter myself and fixed the matter. Earlier on October 4th, the executors sent her a Rejection of my Creditor Claim and she never informed me of it. It contained a clause whereby if we wanted to maintain our rights that we had to file a lawsuit against the estate or lose the rights forever. I only received that document over a month too late when the law firm representing her in my malpractice case sent it to me. I missed that bar date. I have over $400,000 in damages as a result of Ms. Davitt's negligence and will never hire her ever again.
