Arrested as a passenger in a vehicle. After a PROTECTIVE SWEEP was conducted at his residence where his brother the driver rents a room, revealed weapons. Brother was on DUI probation and had a general ... search waiver. Client had a prior felony and could not posess weapons. Weapons were found between the mattresses of his bed. On 1538.5 motion all evidence from the search of the home was excluded due to the overreach of the protective sweep. All felonies and case dismissed.
