Felony charges of possession of marijuana for sales case - a charge of H&S 11359 carries a prison sentence, jail or probation is not available if convicted of this offense. Here, at the preliminary he ... aring, I was able to get the cops to admit and confirm under oath that they had violated my client's Fourth Amendment Rights - even though he was on Probation (with Search Conditions) at the time. I then filed a Motion to Suppress the evidence under Penal Code Section 1538.5. I had the police officer's admissions under oath, ready to use for impeachment, should the story change. However, once the prosecutor realized that it was inevitable that I would win, he dismissed the case.

Client was charged with misdemeanor possession of stolen property. Stolen checks were found in my client's coat pockets. It was unclear as to whether my client knew the checks were there. Case dismi ... ssed once the prosecutor realized that he probably had insufficient evidence to prove my client guilty beyond a reasonable doubt at trial.

Together with Attorney Daniel A. Horowitz we represented a client charged with assault with great bodily injury. We did a preliminary hearing. Attorney Horowitz hammered the complainant until he real ... ized that he was incriminating himself and actually asked for an attorney at one point. We drafted and filed a discovery motion. Once discovery was unearthed that showed that the victim had a long violent history, the prosecutor realized that we would win at trial - case dismissed.

Client was charged with vandalism and endangering a minor - police arrested gay woman client while she was holding a baseball bat after breaking windows from outside a house. Small boy and others insi ... de of house. I claimed defense of another since a man with a history of violence was in the house with the alleged victim. Prosecutor told me that he wouldn't provide discovery on this person because he wasn't relevant. I made him relevant by having my investigator question another witness who put this violent person in the house - even though the police had not done this. Another prosecutor realized I would win at trial after this and dismissed the case.

OUTCOME: Case Dismissed

Client was a professional woman who's career was at risk because she was charged with CPC Section 273a(b) Willful harm or injury to a child. This was a case where the jealous ex-boyfriend (who was sop ... histicated in legal matters) was attempting to sabotage her career and relationship with their children as a means of maintaining control over her. She was alleged to have threatened her minor children with a knife. After a long discovery battle, the prosecutor dismissed the case at the readiness conference, the last hearing before Jury Trial. This was dismissed only because I was prepared for trial, and all the dirt would have been brought out - even though the prosecution had claimed that the boyfriend's motivations were irrelevant and thus inadmissible.
