OUTCOME: Settled

San Jose Police regularly arrest people for being "drunk in public" without probable cause, knowing that the cases would never go trial; literally, every SJPD case where a defendant refused to accept ... a plea bargain was dismissed. Until this suit was filed, SJPD was arresting 4 - 6,000 people per year without probable cause in order to do many improper things, such as prevent a possible future disturbance or simply to let the citizen know that he or she had committed "contempt of cop". As a result of this suit brought by 3 brave men, SJPD changed its policies and retrained its entire police force, resulting in markedly fewer arrests and restoring some public confidence in the department.

Hopkins v. Bonvicino

OUTCOME: As a result, the trial court held that Mr. Hopkins' constitutional rights had been violated as a matter of law, and the defendants settled rather than face a jury.

Mr. Hopkins got into a minor accident that resulted in no damage. After inspecting the cars and speaking with the other driver, Mr. Hopkins drove home and realized the other driver had followed him ho ... me. He went inside to his room. The police arrived and when the other driver told them she thought Mr. Hopkins had been drinking, the officers cooked a story that they feared that Mr. Hopkins was having a diabetic emergency and broke into his home with guns drawn and arrested him. He was charged with a DUI and lost his job, but when the DA learned what had happened, all charges were dropped because the arrest was unconstitutional. The Ninth Circuit Court of Appeals ruled that the arrest was illegal and chastised the police for their conduct, establishing an important precedent still being used to today to protect the rights of citizens.
