San Jose Police regularly arrest people for being "drunk in public" without probable cause, knowing that the cases would never go trial; literally, every SJPD case where a defendant refused to accept ... a plea bargain was dismissed. Until this suit was filed, SJPD was arresting 4 - 6,000 people per year without probable cause in order to do many improper things, such as prevent a possible future disturbance or simply to let the citizen know that he or she had committed "contempt of cop". As a result of this suit brought by 3 brave men, SJPD changed its policies and retrained its entire police force, resulting in markedly fewer arrests and restoring some public confidence in the department.
