If you injured yourself at work, you should report it which automatically files for WC.
Is I-140 receipt number sufficient for H1-B visa transfer and extension by another employer if I-140 is approved?

Workers comp is for on the job injuries. This sounds like an immigration law question. I'll move you over there.
Can you still get a work comp settlement if you have been convicted of a felony?

The felony will not stop you from having a valid WC case unless the injury was as a result of the felony. It may also affect your credibility. ...

With very few exceptions, and they are not likely to apply to this situation, you cannot sue your employer. You would be limited to workers' comp.
