post dissolution child support case
Apr 10, 2005OUTCOME: Arrearage claim settled
Father was alleged by the county to owe approximately $65,000 in back child support based on a child support order that was nearly 20 years old. The children were now adults, and they were not seeking ... any support arrears. Two thirds of the alleged arrearage amount due was interest that had accrued for nearly 20 years, although Father was receiving no notice that an arrearage claim was outstanding. Father paid support during the time when the children were minors, but because the case was so old, he no longer had all the records showing his prior payments. The county took action against Father without proper notice, violating his due process rights, including wage garnishment, suspending driving privileges, and causing a negative credit rating. I demonstrated such due process violations, and had all negative actions against Father reversed. I then had the case transferred to the appropriate county, whereby I got the arrearage claim reduced to a small fraction of the original amount that was alleged due.
