Sounds like SHE is abusing him - at least psychologically. Have him meet with an attorney to review his immigration options

It depends on whether you are applying after 3 or 5 years.

Perhaps the file had not yet been reviewed at the time of the request. She can be denied. Or she can be approved. Much depends on when the timing...

You can do everything and still be denied. CIS and EOIR do that everyday of the week.
My father IR5 was denied based on 10 year bar for illegal stay in the US. What can i do???
