H1B petitions with extension are taking 6 months. My concern is there would be a denial in her absence. An RFE may be acceptable.
Two employers can apply GC-PERM then I-140 separately for an employee.

It depends upon the take over. The company attorney may guide you what if any petition is required and the paperwork you must carry.
