245k applies to adjustment of status where a person has been out of status 180 days or less.
Unauthorized employment would put the person out of status and accruing unlawful presence who may be able to return to the US after 3 years.
She may choose to marry whomever she may wish. However, if she does not marry the K1 sponsor she must depart the US and be sponsored from abroad.
