My suggestion: leave and call the police. Let them handle it. Do it yourself justice does not usually go well.

The DA decides whether to prosecute the case. My suggestion make sure that your husband has a great (not good, great) lawyer.

I think that this is the statute that you're referring to. No lawyer can tell you for an absolute certainty what a judge would rule.
