Samson vs. Fogarty
May 12, 2011OUTCOME: Client won.
Client, who had owned 50% of her father's $3M real estate portfolio since 1980 with survivorship rights - meaning that client would get the other half automatically upon father's death - sued in quiet ... title to invalidate grant deeds conveying father's retained 50% of all properties to a trust controlled by client's sister and brother (thereby terminating client’s survivorship rights in the realty) based on fraud and undue influence and for a judgment awarding client 100% title retroactive to the date of father's death and declaring grant deeds to be the product of fraud and undue influence perpetrated by sister and bother.
