you need a promissory note and a deed of trust. you would record the deed of trust against the property of the borrower. Have a local lawyer draw...

you still owe them and if you do not comply with your loan obligations with them they will sue you.

you need to report this event to the state bar and perhaps the issuing authority if you cannot resolve this matter with the lawyer.
Contractor exceeded maximum estimate by 20% besides change orders. Do I pay any cost over run on maximum estimate?
