Why do you need a copy of the petition? You are entitled to a copy of the certified LCA on the first day of employment. The employer is not...

Had an H1 converted to H4. Could we do change of status back to H1 before november as my previous H1 was valid till DeC?

If you are currently on H-4, your new employer can seek change of status for you. Remember - you can start working after the petition is approved.
