OUTCOME: DUI CHARGES DISMISSED. CASE REDUCED TO RECKLESS DRIVING. NO IID REQUIRED!

There's always more than one way around the barn! This case involved a .13% breath test in Oakland. After several attempts to resolve the case for a wet reckless in Department 107, I continued the ca ... se again for further pre-trial in Department 104. The DA was new and didn't have the case file and the judge was filling in for normal judge Brosnahan who was on vacation. The stars aligned just right and I was able to sucessfully negotiate a settlement which dismissed the DUI and client accepted offer of plea to "wet" reckless driving. Client received three years of court probation, reduced fine of $993, three month DUI school and NO JAIL OR SWAP. Most important, client avoided the IID requirement for Alameda County. No mandatory license suspension and DMV remains pending, although an administrative suspension remains likely.

Today I settled a first offense DUI in Department 104 in Oakland. Client was stopped for speeding and subsequently provided a breath sample which registered .15% BAC. We exhausted our negotiations wi ... th the District Attorney for a "wet" reckless driving plea to avoid the mandatory ignition interlock device requirement and ultimately filed a Motion to Suppress Evidence. A hearing was held and the arresting officer testified thus justifying the initial detention. After we exhausted our options, client decided to accept offer to plea to DUI. Client received three years informal court probation, one day of SWAP in lieu of actual jail time, three month first offender DUI school and a fine of $1,813. Client opted to serve full six month license suspension to avoid the ignition interlock requirement.

Case results are a relative thing. In this case, I represented a commerical driver who was placed on paid administrative leave while his DUI case/license suspension remained pending. Due to the extre ... me facts of this case (second offense, high BAC, collision), client was definately going to lose his license and suffer a lifetime ban of his commerical privilege. The practical goal was to continue the case until client had been terminated and eligible for unemployment benefits. No easy task considering that Contra Costa County is the slowest Bay Area county in processing DUI cases. I was able to keep client's license valid for over six months and he achieved these goals. As for settlement, he received a favorable second offense disposition: four years informal court probation, fine of $1,876, one year ignition interlock device ("IID"), 18 month DUI school, and 31 days HOME DETENTION. NO ACTUAL JAIL OR SWAP REQUIRED. License suspended for ninety days and restricted for nineteen months.

No doubt, this was a ugly case. Client was a young man who had a commercial driver's license and it was necessary to keep his job. Client caused collision when he fliped his vehicle on the freeway wh ... ile driving recklessly. Subsequent blood draw revealed a BAC of .26% (well above the .15% special enhancement). Complicating matters, Client has suffered a prior DUI conviction in 2005. This case was about "damage control." I successfully kept the DMV from suspending client's license for neally one year as he received paid administrative leave and looked for a new career. As for the court, we negotiated a result for four years informal court probation, fine of $1,876, 18 month DUI school and 31 days of HOME DETENTION= NO JAIL OR SWAP. Client forced to have ignition interlock device ("IID") for first year of probation. Commerical license revoked forever, actual license suspended for 90 days with eligibility for "restricted license" thereafter.

Today I resolved a tough case for a single mother who was stopped for a misdeanor for driving on the wrong side of the road. A subsequent blood test revealed an incredible .32% BAC, meaning that nearl ... y a third of the client's blood was alcohol. I negotiated a very reasonable settlement at Pre-Trial Conference which client gladly accepted. Client received minimum three years informal court probation, fine of $1,805, 9 month/level two DUI school, and three days of SWAP (community service) in lieu of actual jail time. Client's license suspended administratively prior to retaining my office. Accordingly, client was suspended for thirty days and restricted until completion of the DUI school. Overall, an excellent result.
