Settled case today for excellent result of ... 3 years probation, $1889 fine, 3 days of SWAP and only the 3 MONTH DUI SCHOOL, saving the client the additional 6 months that he would normally be required to complete with a high BAC case.

All misdemeanor criminal defendants are eligible to petition the court for a dismissal of their conviction from their criminal record once they've successfully completed their term of probation. This ... is called an expungement and is done pursuant to California Penal Code Section 1203.4. When defendants have only one criminal conviction on their record, it's even more important that they seek this sanitary relief as soon as they become eligible. Today, I obtained just such a dismissal for a prior DUI client. Client was arrested for DUI in 2015 with a .11%, .12%, and .13% BAC after a collision no less. I was able to get the DUI charges reduced to Reckless Driving which significantly reduced her penalties, including a reduction to a 2 year probation term, which BTW allowed her to get off probation a year early so we could get this expungement done ASAP. Crucially, client was a college student at the time of DUI and now entering the workforce.

Client agrees to blood test which returns ... result of .16% BAC, thus qualifying him for an "enhanced" DUI charge due to the high BAC. Today, we settled the case for a remarkable result. DUI charges dismissed and case reduced to "Reckless Driving" with client sentenced to 3 years of probation, fine of $964, and a 3 month DUI School. No mandatory license suspension and most importantly, no IID.
