Complex Adjustment of Status & International Travel Strategy (Corporate Legal Counsel & Spouse)
Jul 30, 2026OUTCOME: Approval after an aggressive in-person USCIS interview
Background & Challenge: A Deputy General Counsel in H-1B status pursued an EB2 I-140/AOS. We downgraded to EB3 to take advantage of a more favorable priority date and filed adjustments for the couple. ... The spouse had an E2. In the AOS, the couple faced significant travel and status complications amidst changing USCIS policies on combination cards, expiring visas, and sudden international travel restrictions while abroad. Legal Strategy & Outcome: We structured a multi-tiered legal and travel strategy combining Advance Parole entries with underlying H-1B and H-4 extensions and consular processing options. This provided dual-intent protection against shifting federal immigration policies, allowing the clients to maintain uninterrupted employment authorization and travel safely between the U.S. and international destinations.
