Sam Samaritan, 26 years old, stopped his car on the shoulder of Southbound Highway 101 at 3:00 a.m. to assist the driver of a disabled vehicle facing the wrong way on the roadway. Samaritan parked his ... car on the shoulder, turned on his flashers, and got out of his vehicle to assist. Two limousines owned and operated by Limo Company were following each other in the fast lane. After moving the driver to the center median, and while other drivers tried to redirect traffic, both Samaritan and the driver of the disabled vehicle were struck by one of the limousines. We contended that the limousine drivers failed to exercise reasonable care because they were driving too fast and following too closely for the conditions, preventing them from timely observing the hazards in the roadway in time to avoid them.
