Esha Bandyopadhyay

For close to two decades, Esha has been practicing intellectual property and technology-related commercial litigation and counseling in the Bay Area. Previously one of the youngest partners at Kirkland & Ellis LLP, Esha brings to any team a keen sense of trial strategy and jury presentation. Earlier this year, Esha successfully led a team of nine attorneys to a defense-side verdict in a case brought by a non-practicing entity in East Texas.

Esha has played a key role in numerous other cases, both in District Courts and in the ITC. In those matters, she has successfully obtained verdicts of patent invalidity, obtained jury verdicts in the millions, and recovered millions in settlements. Esha’s successful outcomes have resulted from winning cases at trial, winning cases on summary judgment motions and motions to dismiss, and prevailing on advantageous claim constructions.

Esha has successfully represented companies ranging in size from Fortune 100 to emerging start-ups, as well as highly innovative inventors. Esha’s patent litigation engagements have involved diverse and technologically complex subject matters ranging from computer hardware, wireless standards, optical character recognition, image processing, medical devices, and consumer products. Esha also has significant experience with trade secret disputes in high-tech industries, and has litigated numerous copyright, trademark, Internet, and false advertising matters.

In 2000, at the age of 22, Esha received her law degree from Boalt Hall. She received her B.A. in Economics, with highest departmental distinction, in 1996 from UC-San Diego. At the age of 18, she was the youngest graduate in the history of the university. 

Esha is frequently invited to serve as a guest speaker and lecturer at Boalt Hall and Hastings College of the Law. She is involved with the Silicon Valley IP Lawyers Association and the Women’s IP Lawyers Association.
