BALCA Overturns Denial
Oct 31, 2018OUTCOME: On October 31, 2018, BALCA vacated the denial of certification and remanded for continued processing.
On behalf of my client I filed an application for permanent employment certification to sponsor a foreign citizen. In January 2014, the Labor Department’s certifying officer emailed the school district ... requesting a draft advertisement for recruitment, and I responded a week later with the requested ad. In March 2014, the certifying officer emailed a letter for a correction to the drafted ad, but we never received it and as a result, the officer denied the employment certification application. We filed a request for reconsideration which was also denied by the certifying officer, and I subsequently filed an appeal with BALCA.
