Felix Rijos was operating a motor scooter when he was struck by a taxi. He sustained a minimally displaced fracture of a rib, a tear of each shoulder's glenoid labrum, subluxation of the right shoulde ... r, disc herniations of his C2-3 and L5-S1 intervertebral discs, and disc bulges of C4-5 and C5-6 discs. Defense counsel conceded that Mr. Rijos sustained a rib fracture but argued the other injuries were not related to the accident. The defense argued the post-accident x-rays did not reveal a remarkable injury of either shoulder joint and Rijos' shoulder tears were the result of moving heavy furniture at work. The defense also argued that Rijos sustained a herniation of an intervertebral disc in a prior motor vehicle accident.
