Client was accused of assaulting an officer. He was actually a dogcatcher who came on her property without a warrant, saying he was going into her backyard to take her dog. When she got in his way, he ...shoved her and she shoved back. When she went to file a complaint, the city said, "Oh, no. We're charging you with PC 243(b), battery on an officer." At one point, the judge tried to coerce me into accepting an infraction offer -- I was appearing without my client. I refused that option, communicated the offer to her, advised she reject it and set for trial. Today (2/10/2012) the District Attorney dismissed for lack of evidence. This case was particularly interesting to me because it was a misdemeanor, but I had to fight it like a felony -- filing several motions, etc. -- and it took almost a year to get the dismissal. NCIS investigated case and he was ultimately charged by the State of California ...with this felony strike. A few weeks before trial, the District Attorney's Office offered a misdemeanor, with no custody time, which the client accepted.
