Client arrested after a search warrant revealed a small amount of cocaine in the client’s apartment (after 3 controlled buys) along with over $1600 in cash, packaging materials, a purported drug ledger ... and evidence that client threw out of his apartment window that contained marijuana and more packaging materials. Client had prints on several small zip-lock plastic baggies that were allegedly intended for cocaine packaging. Client charged in a single count indictment and, at the close of proof, we requested that the court charge CPCS 7. The court agreed to charge the lesser included offense, and after about 2.5 hours of deliberation, the jury acquitted on the CPCS 3 and convicted on the CPCS 7. Client was a violent predicate and faced up to 15 years on a conviction of CPCS 3.
