I am a hard-working, tenacious attorney whose central duty, part of the sacred oath I took on December 16, 1980 in the Sacramento Memorial Auditorium when first sworn in to practice law, is to represent the client zealously but who never forgets that he performs these services not just within the framework of federal and state Constitutional limitations but, equally important, under the watchful eyes of God as well as the Courts. A client's often involuntary immersion into the world of civil, criminal, or any other litigation is never to be taken lightly, is fraught with peril, and without proper preparation can produce unpredictable consequences. That is why, when you face such a challenge and especially for the first time, you should never, EVER enter a courtroom -- anywhere -- without counsel by your side, whether it is this attorney or another. There is not just a legal, but an economic, cultural, physiological, psychological, and even spiritual dimension to each exposure to the Court system, the question in nearly every case being one of degree; and if you are not prepared -- or properly guided -- you can face, especially in the more serious cases where your opponent has retained veteran counsel, adverse results that you might never have intended or anticipated. To be sure, counsel is not a guarantor of the outcome of your litigation nor should an attorney ever raise your expectations, especially when the evidence does not support such ill-advised encouragement. But in nearly every instance the presence and advice of counsel are to be soberly considered as vital, in helping to even the odds when you are required to enter this new and, often, terrifying judicial world. I live in this world, and have done so for nearly 36 years. I breathe this world. So do my colleagues, so much so that if we cannot settle a dispute it sometimes seems we scratch and claw at one another across the counsel table until the Judge puts an ends to such antics with a sharp "Thwack!" of his or her gavel, or worse -- it is a risk we eagerly assume in the desire to serve our clients to the max.
