This was a heavily disputed illegal lane change case. On July 20, 2006, Plaintiff Hernan Cortez (Plaintiff) was involved in a severe motor vehicle collision. Plaintiff was operating a motorcycle whil ... e traveling southbound in the number one (1) lane on Euclid Avenue, north of Edison Avenue in the city of Chino. Defendant Nicholas Tavasci (Mr. Tavasci), while in the course and scope, was operating a tractor trailer and hauling livestock for Defendant Wingfield Livestock from Arizona to Chino, California. Mr. Tavasci had been traveling all night and was only a couple of miles from his intended destination, located off of westbound Euclid Avenue. Prior to the collision, Mr. Tavasci was traveling southbound on Edison Avenue approaching Euclid, where he intended to make a right hand turn. Mr. Tavasci then illegally entered the left hand turn pocket, and used the left hand turn pocket to make a right hand turn onto westbound Euclid, in violation of CVC 22100. Defendants claimed that Plaintiff was traveling at an unsafe speed and was not a competent rider because he did not have a license to operate a motorcycle. The collision between Plaintiff's motorcycle and Mr. Tavasci's semi-truck was significant. When Mr. Tavasci went from the left hand turn lane, without signal or warning into Plaintiff's lane of travel, Plaintiff's motorcycle broadsided the passenger side of Mr. Tavasci's livestock trailer. Consequently, Plaintiff's body was rag dolled underneath Mr. Tavasci's trailer. Plaintiff could not make any evasive maneuvers. Plaintiff was knocked unconscious. When Plaintiff regained consciousness, he realized that his left leg was crushed and his broken leg bones were protruding through his torn jeans. Plaintiff was transported via ambulance to Arrowhead Regional Medical Center where emergency surgery was performed to stabilize the compound fracture of Plaintiff's left tibia and fibula. He had obtained an attorney after the accident however his case was discharged. Robert May lead the litigation and resolved the case at mediation.
