Client is weaving in and out of lane. Stopped and shows subjective signs of impairment (Bloodshot, watery eyes, odor of alcohol, slurred speech). Client fails to perform field sobriety tests as demons ... trated. Client blow .165/.180 on preliiminary alcohol screening tests. Then blows .186/.177 on the Alcotest 7110 Mk-III-C. We were able to win both the DMV hearing and have the case dismissed showing the officer had no probable cause to stop the defendant. Case was set for trial but was dismissed by the court prior to trial.

Defendant was allegedly traveling in excess of 100 MPH on a motorcycle weaving in and out of traffic. When stopped he allegedly exhibited all the signs of intoxication (red/watery eyes, slurred speech ... , and unsteady gait). He had an odor of alcohol about him. He tested above the legal limit. DUI charges were dismissed.

After an eight day trial, Mr. Jones was acquitted on both 23152(a) and (b) charges. He was also acquitted of lacking insurance at the scene of an accident. He was convicted of leaving the scene of an ... accident. However, he always admitted he left the scene, albeit not of his own choice.
