PRE ... -trial the charge was successfully reduced from a D Felony to an E-Felony based upon the application of the defense on the prosecutions failure to properly charge the higher felony. Thereby the defendant's exposure was reduced from 2 1/3 - 7 years to a maximum of 1 1/3 - 4 years. AT trial defendant was found NOT GUILTY of the DWI but guilty of the No License, No Insurance and expired inspection. POST TRIAL, on defense counsel's motion, the charges of No License and No Insurance were dismissed. Mr. Fisher paid a $25.00 fine on the expired inspection ticket.
