OUTCOME: Case Dismissed!

This matter was referred to Mr. Kent by a Deputy District Attorney in an adjacent county. Unfortunately, the client initially hired a less expensive firm to represent him, and somehow the court date wa ... s missed. The client returned to The Kent Law Firm, APC and hired Mr. Kent to get involved in the matter. Mr. Kent immediately noticed an apparent due process and speedy trial violation. Mr Kent prepared and filed the appropriate motion to dismiss. After arguments on the motion, the judge agreed with Mr. Kent and the case was dismissed!

OUTCOME: No Custody Time and No Fines!!!

Client retained Mr. Kent to assist him in a complex 3rd felony DUI with an accident. Client had previously served a 6 year term in prison for his prior DUI. This DUI involved a 0.305% (Nearly 4 times t ... he legal limit) blood alcohol level along with impairing drugs in client's system. Mr. Kent proactively advised the client to enroll voluntarily in the SCRAM (SubCutaneous Random Alcohol Monitor) Program to be able to prove that the client was no longer drinking. Similarly, Mr. Kent had client get in contact with his psychiatrist to work out a treatment program and to balance out the client's medications. Mr. Kent had also wanted client to start seeing a therapist weekly in additional to his 4 AA's per week. The client was initially very reluctant to go to therapy, but eventually followed Mr. Kent's advice and has stated this counselor has absolutely changed his life! After the case was filed, Mr. Kent was able to get the court to order client in to SCRAMx, which is a combination of the aforementioned SCRAM Program, along with Electronic Monitoring. This not only allowed the client to continue to work to support client's family, but also allowed client to earn day-for-day jail credits while in the SCRAMx Program. The case was ultimately resolved for a state prison sentence, but client never had to serve a day in custody, as the credits from the SCRAMx Program credited his entire sentence! The client is still employed, supporting his family, and on a healthy road to longterm recovery!

When client came to see Mr. Kent, his prior attorney and advised that he accept a state prison plea. Client had spent about 180 days in jail prior to posting bond we he came to see Mr. Kent. Although h ... e was facing 9 years in prison for the twenty (20) pounds of methamphetamine found in his vehicle that he was driving, Mr. Kent was able to resolve the case for probation, and no additional jail time!

After hard work, and investigation, Mr. Kent was able ... to convince the prosecuting attorney to dismiss all the charges except Assault with a Deadly Weapon, but was still Abel to negotiate away the Great Bodily Injury and Strike enhancements. The client was placed on probation with credit for the 2 days he did in jail prior to posting bond, and will do no additional jail time! Moreover, the prosecutor has agreed to the reduction to a misdemeanor upon successful completion of probation! and

Client was charged with stealing over $3,500 in watches, pins and other memorabilia while Client's child was asleep in a stroller. Mr. Kent was able to get the charge reduced to a midst,enaor, and then have Client placed into Misdemeanor Diversion that resulted in a complete dismissal and expungement of the charge!

After researching, and filing the appro ... priate motion, the matter was litigated, and the judge agreed with Mr. Kent that the officer had no legal basis to pull over Client for simply having dark tinted windows, The case was ultimately dismissed!

Mr. Kent was hired to take over the case after the original attorney had encourage the defendant to accept an offer of 25 years in state prison. Mr. kent had referred the Clients family back to the ori ... ginal attorney numerous times, as this was a life case, and any non-life offer was a good result. The family persisted, and hired Mr. kent after being advised that he may not be able to achieve a better result. After through investigation and analysis of the case, Mr. Kent was able to resolve the case for 15 years in state prison, and save the client 10 years of prison time!

Client was arrested for possessing several ounces of cocaine and methamphetamine, over $15,000 in drug proceeds, and three firearms. Amongst other things, the police also seized over $50,000 worth of ... jewelry, and approximately $65,000 in bank accounts. Mr. Kent was able to work out a resolution with no jail time, and the return of the $50,000 in jewelry and $65,000 in seized bank accounts!

OUTCOME: From a Life Sentence to 5 Years in Prison!

The client was referred by two other criminal defense lawyers due to Mr. Kent's expertise in handling what are commonly referred to as Watson Murder cases. A Watson Murder is when the driver of a car i ... s driving under the influence of alcohol and/or drugs and causes an accident where someone is killed. The charge is elevated from manslaughter to 2nd Degree Murder (Watson Murder) when the prosecutor's office believes they have evidence of malice. The malice used in Watson Murders is called implied malice, and is often based on the client having one or more prior DUI's. In this matter, the client had 2 prior DUI convictions and a blood alcohol level of 0.21%, over 2 1/2 times the legal limit. Mr. Kent was able to convince the DA's office to have a meeting with the trial lawyer, the homicide unit prosecutor and the 2nd-in-Command of the DA's office, and was fortunately able to convince them to reduce the charge from 2nd Degree Murder to manslaughter. The sentence in 2nd Degree Murder is 15-years to life, meaning the client would not have been eligible to be considered for parole until serving 15 actual years in custody, and then would need the Parole Board to recommend release before being released. By the charge being reduced to manslaughter, the agreed sentence was 10 years in prison, and the defendant would earn 50% credits, which would result in an actual 5 years of incarceration. This reduced the punishment by at least 10 years!
