John Doe v. Los Angeles County

OUTCOME: Permanent Total Disability Finding

Applicant, a Deputy Sheriff, working in a youth facility, sustained a severe infection that resulted in part of his spine being removed plus ongoing immune system and internal problems. The County of L ... os Angeles denied the claim even after its own evaluating internists and neurologists found the claim compensable. The applicant was forced to treat through his group health HMO, Kaiser, who provided over $300,000 of medical care. The defendant even attempted to force the applicant to undergo HIV-AIDS testing which I successfully opposed under medical privacy laws and protocols that the county was not following. After trial, the County of Los Angeles was forced to reimburse Kaiser over $300,000 and the applicant eventually received an Award of Permanent Total Disability (100% permanent disability)

Cal-Tech Precision, Inc., uninsured, v. WCAB

OUTCOME: Defendant uninsured employer's writ denied.

An employer, uninsured for workers' compensation benefits for its employees, filed a petition for writ of review with the California Court of Appeal (4th Appellate District, Division 3) seeking to over ... turn an adverse trial decision in which the injured worker was awarded monetary and medical benefits. The appellate court both denied the employer's appeal but also awarded the employee reasonable attorney's fees as the appeals court court that the employer's appeal had no reasonable basis. I wrote the brief on behalf of the responding employee. The decision issued May 15, 2008 and is reported in the Matthew Bender publication California Compensation Cases.

OUTCOME: 94% permanent disability award

A county in Southern California , self-insured for workers' compensation, denied a cumulative trauma claim that I filed for a then recently retired Deputy Sheriff who worked over twenty-years as a peac ... e office for the county. The applicant had a history of heart troubles over the last few years of his employment, and after much litigation including doctor depositions, the applicant received a 94% permanent disability award plus an award of medical care to his cardiovascular system, skin, and orthopedic system plus hearing aids.

Successfully represented The Boeing Corporation and its insurance company, a member of the AIG Group, in a claim for penalties over the refusal of the defendant to pay for purported home health care se ... rvices by family members of an injured worker. The injured worker had refused the provision of home health care services by professionals and instead wanted the defendant to pay for family members to provide such at the expense of the defendant. I was the attorney at the trial, reconsideration, and appellate level and the defense was successful at all levels.
