Unless you actually sustained an injury, your case has little value.
Got in a fender bender not at fault. I was the passenger . The next day I was stiff and my neck hurt . I went to my chiropractor

You can certainly sue, the issue is whether you will be able to collect. It is not worth the time to pursue it if the judgment is uncollectable.

It will be based on the contract. In CA it is typically off the gross.
