Mr. Dawe represented the Plaintiff in this insurance coverage/bad faith case, which was tried to a federal jury in October 2013. The Plaintiff/Insured, a plastering company, alleged wrongful denial of ... insurance coverage by Liberty in two underlying construction defect lawsuits brought against the insured. Liberty denied the duty to defend both claims and the Plaintiff was forced to represent itself, ultimately settling both claims with a modified covenant not to execute in one of the two cases. Plaintiff was awarded consequential damages, attorney fees and punitive damages comprising the $2.2 million judgment.
