  1. Chapter 7 bankruptcy

    Chapter 7 contemplates an orderly, court-supervised procedure by which a trustee takes over the assets of the debtor's estate, reduces them to cash, and makes distributions to creditors, subject to the debtor's right to retain certain exempt property and the rights of secured creditors. Because there is usually little or no nonexempt property in most chapter 7 cases, there may not be an actual liquidation of the debtor's assets. These cases are called "no-asset cases."

  2. Chapter 13 bankruptcy

    Chapter 13 is designed for an individual debtor who has a regular source of income & who has limited unsecured debt & secured debts. Chapter 13 is often preferable to chapter 7 because it enables the debtor to keep a valuable asset, such as a house, and because it allows the debtor to propose a plan to repay creditors somewhere between 0-100% of their debts over time – usually over three to five years. Chapter 13 may be the only alternative for consumer debtors who do not qualify for chapter 7.

While attending Law School, I served as a judicial extern for the Honorable Kathleen P. March, United States Bankruptcy Judge for the Central District of California, Los Angeles Division.  It was during my externship, that my interest in the debtor/creditor relationship and finding ways to resolve issues between the two first arose.  Since then, I have focused my practice solely on bankruptcy, insolvency, debt negotiation/settlement for both debtors and creditors.  


I am admitted to practice before the United States District and Bankruptcy Courts for the Southern, Central, Eastern and Northern Districts of California and the Ninth Circuit Court of Appeals and have appeared before many of the Bankruptcy Judges in each District.  I have also successfully briefed and argued matters before the Bankruptcy Appellate Panel, District Court and the Ninth Circuit Court of Appeals.

 

My published opinions include: ACIC v. Kronemyer (In re Kronemyer)  405 B.R. 915 (BAP 9th Cir. 2009); Cohen v. Tran (In re Tran) 309 B.R. 330 (BAP 9th Cir. 2004); Soderlund v. Cohen (In re Soderlund) 236 B.R. 271 (BAP 9th Cir. 1999).

Bankruptcy Chapter 7 and 13 U.S. Trustee Audit - Probate Complications
At the time I met Misty I was involved in a complicated Bankruptcy case pertaining to Probate matters that had been in dispute for three years. My court case at that time had cost me in the upper dollar amount of 80K, paying three pervious attorneys to defend me. Due to the complications of my Bankruptcy and Probate case none of my previous three attorneys seemed to know how to end the case filed against me so that I could have my Bankruptcy approved and Probate case closed. After meeting with Misty she explained the complications of my case. The litigants who filed the case against me were using the Bankruptcy courts to continue their Probate arguments thus effectively not allowing me to complete my Bankruptcy and settle the Probate case. I was being audited by the U.S. Trustee and sued in Bankruptcy Court for probate matters. Misty immediately contacted the U.S. Trustee who was auditing me, meeting all the Audit requirements she was able to have my Bankruptcy audit approved with no penalties or disagreements all within weeks. She then began to work on a strategy to have my Bankruptcy converted to a Chapter 13 that effectively ended the dispute regarding the Probate case. Misty strategy worked my Bankruptcy was approved and the Probate case that had been an open court case for three years was settle and approved also. I personally be leave if Misty was my attorney during the initial opening of my case it would not had lasted three years and cost me 80K. Her dedication to clients, her morals and honesty far exceeds her peers. Misty is an attorney that sees more than a client, she involves her self in a case as if it were personal and treats her clients like family, she is an attorney that takes action and truly wants a resolution in the best interest of her client.

Review
Misty Ann Perry-Isaacson helped my wife and I during a difficult time. We had to declare bankruptcy and she helped us get through it. We weren't sure if it would affect our business or how it would affect our lives. She was very professional, knowledgeable and compassionate. I would highly recommend her to anyone that was in our position. She made everything very easy to understand and kept us updated as we waited for the bankruptcy to be discharged.

Misty is the best :)
Misty was outstanding in helping me with my bankruptcy. In the course of my business (real estate), I have worked with many lawyers, and in general I do not have a high opinion of attorneys. Misty is an exception - not only did she handle my complex case (dozens of assets, 30+ creditors, community property issues) very skillfully, she also managed my fears and concerns with compassion and understanding. When a creditor unexpectedly disputed the bk, she helped me in my decision to settle. I have referred her since to my clients, and she did an outstanding job for them as well, in filing some removals of liens.

Giving prompt attention to the needs of clients
Making a poor personal or business decision and losing everything is a very stressful time in one's life. Working with a professional like Misty makes a poor decision palatable. Misty explained everything to my wife and I in detail and was prepared for all follow-up questions and documentation. Misty provided my wife and I similar case study outcomes and prepared us for all possible questions and probable decisions.
