You may very well have to evict. Just because the 30 day is up does not mean that the tenant will move. Get a lawyer as soon as the 30 days is up...

By all means they can consider what they want to consider as there is no law that requires them to give you a loan mod.

This question is not completely clear to me. But if the foreclosure was already paid by a third party you would NOT have to pay the HOA.
