Yes... the city can enforce its building and safety codes. Do not fight city hall.

This is a question of fact for a judge or jury, not the parties to the lease. You can not prevent
her filing suit, if that is what she wants to do.

Yes, lack of heat typically constitutes a constructive eviction and an abatement in rent.

AS long as the landlord still owns the property, you must pay rent. You can recover prepaid rent if he loses it.
